Abstract: To combat against technological risks to environment caused by scientific uncertainty,precautionary principle is firstly established in environmental law. Based on theoretical and practical analyses of precautionary principle,the definition,nature and the role of precautionary principle are discussed in the article. For the purpose to control human health,environmental and social risks,it is suggested that precautionary principle and relevant risk assessment systems should be incorporated into China’s patent law.
